A story about some Ole Chadashim

Our (Ronit and Ariel) new build home was demolished in 2003, by the ILA Israel Land Administration. We had no license, the ILA wouldn’t give it. The parents of Ronit came to live in the land, on this peace of ground, more than 60 years ago.  Just before the independence war. The Jewish Agency putted them in Ein-Karem, a very beautiful place, an outskirt of Jerusalem.  After the mother came in the land as a refugee from Poland and have lived there ever since.  The mother of Ronit is a survivor of the Holocaust, her mother lost many members of her family to that heinous event. Her mother is a well known Holocaust survivor (that seemed to be treated with contempt.) The father came from Persia (Iran). From 1948 the parents ‘rented’ the ground from ‘The Amidar’ ‘Amidar’ (Hebrew: עמידר‎ is a state-owned housing company in Israel.)

They rented the ground until ’86. They bought it for 27% of the day value. Because that was their right until ’86. Afterwards, a law came to take that right away. More than 70 families in Ein-Karem couldn’t come to the point to buy it. They couldn’t make the money to buy it. After, more than 60 years the ILA makes it to them clear to leave the areas or to buy it for 60% of day value. And that is a lot of money. The father of Ronit worked years, almost day and night, to come up with the money for our house. What the ILA demolished in 2003.

In reality they bought almost all the ground in square meters, including the house were we Ronit, Ariel and our children live. They signed for a peace of ground with two rooms. The ground complete surrounded with a fence. The house of the mother had one room. We in the other ‘room’. But later after signing the sealing-contract the ILA came with a map what showed that the square meters where, included: in the house and the rooftop. So, only a small peace of ground was left. With on one side no border and the ILA never knew exact the border.  The family could never have any contact about ‘the deal’ with the ILA.

Our new build house was demolished as we were supposedly not legally living there and that the land did not belong to us.  However since that incident, we have being residing on that same property, in that small building, which is 20 square meters.

We could afford a Private Attorney (was our last money) for assistance in clearing the discrepancy of the land ownership.  Ronit and her father who is now very old have had to sit through countless court hearings for months and months and months. The last six years. A waiting each trial hearing months apart, Ronit had an excellent proof of ownership and what seemed to us as being a delayed response to her credibility.  The Court knew they owned the land and the Judge on an occasion even apologized for what she (the mother) had to endure with being ‘beaten up’ in the midst of her own property being utterly destroyed, by Israeli soldiers. (German soldiers tried to break open the rooftop of the house, in Poland, where they were inside to ‘pick them up’ but she escaped….. . Later to Israel)

The judge declared that the ILA has no defense, in the proof that Ronit brought about the ground. He made it clear that the case was turned 180°. From the claim, we are the invaders of state-ground. To: the ILA are the invaders of privet ground.

We have two beautiful children who are growing in the love of their Moshiach and have had to dwell together with us in one room even till their adolescence which is imminent. I, Ariel, was a carpenter but could not go on working because of my back. Ronit is working in a medical lab.  But the salary is low.

After waiting a further 8 months to hear the final verdict, today Ronit was told that we have to vacate the property within 4 weeks.  The judge rejected all our claims. As a matter he ‘deleted’ all what ‘spoke’ against the ILA.

We have no where to go, we have had our life's earnings destructed before our eyes, yes even our little children were witnesses to this heartless treatment.

The ‘mafia’ is a heavy power in the modern state of Israel.

The modern state of Israel, need Yeshuah Rabbeinu. Without Messiah we don’t survive!

Come let us do together Teshuvah until,

Zec 12:10  And I will pour upon the house of David (The whole House of Israel), and upon the inhabitants of Yerushalayim, the spirit of grace and of supplications: and they shall look upon me whom they have pierced, and they shall mourn for him, as one mourned for his only son, and shall be in bitterness for him, as one that is in bitterness for his firstborn.

Jer 31:7  For thus said יהוה, “Sing with gladness for Yaaqoḇ, and shout among the chief of the nations. Cry out, give praise, and say, ‘O יהוה, save Your people, the remnant of Yisra’ĕl!’  (Please Abba, now?)

Jer 31:8  “See, I am bringing them from the land of the north, and shall gather them from the ends of the earth, among them the blind and the lame, those with child and those in labour, together – a great assembly returning here. (Please Abba, now?)

Jer 31:9  “With weeping they shall come, and with their prayers I bring them. I shall make them walk by rivers of waters, in a straight way in which they do not stumble. For I shall be a Father to Yisra’ĕl, and Ephrayim – he is My first-born.  (Please Abba, forgive us?)

Jer 31:10  “Hear the word of  יהוה, O gentiles, and declare it in the isles afar off, and say, ‘He who scattered Yisra’ĕl gathers him, and shall guard him as a shepherd his flock.’  (Please Abba, now?)

19  For He looked down From the height of His set-apart place; From heaven יהוה viewed the earth,

20  To hear the groaning of the prisoner, To release those appointed to death,

21  To declare the Name of יהוה in Tsiyon, And His praise in Yerushalayim,

22  When peoples gather together, And reigns, to serve יהוה.

23  He has humbled my strength in the way; He has shortened my days.

24  I said, “O my Ěl, Do not take me away in the midst of my days; Your years are throughout all generations.

25  “You did found the earth of old, And the heavens are the work of Your hands.

Psa 103:1-22  Bless יהוה, O my being, And all that is within me, Bless His set-apart Name!

2  Bless יהוה, O my being, And do not forget all His dealings,

3  Who forgives all your crookednesses, Who heals all your diseases,

4  Who redeems your life from destruction, Who crowns you with kindness and compassion,

5  Who satisfies your desire with the good, Your youth is renewed like the eagle’s.

6  יהוה is doing righteousness And right-ruling for all the oppressed.

7  He made known His ways to Mosheh, His acts to the children of Yisra’ĕl.

8  יהוה is compassionate and showing favour, Patient, and great in kindness.

9  He does not always strive, nor maintain it forever.

10  He has not done to us according to our sins, Nor rewarded us according to our crookednesses.

11  For as the heavens are high above the earth, So great is His kindness toward those who fear Him;

12  As far as east is from west, So far has He removed our transgressions from us.

13  As a father has compassion for his children, So יהוה has compassion for those who fear Him.

14  For He knows how we are made; He remembers that we are dust.

17  But the kindness of יהוה Is from everlasting to everlasting Upon those who fear Him, And His righteousness to children’s children,

19  יהוה has established His throne in the heavens, And His reign shall rule over all.

Psa 103:20  Bless יהוה, you His messengers, Mighty in power, who do His Word, Listening to the voice of His Word.

21  Bless יהוה, all you His hosts, You His servants, who do His pleasure.

22  Bless יהוה, all His works, In all places of His rule. Bless יהוה, O my being!

 18-7-2010:

Today the father of Ronit, brings a letter to the Middle Court where in we ask, To stop the case, selling of the land. And to give us an answer if we receive all the square meters of land that we are leasing. That until a clear answer nothing shall be done. Because if they give us all the land, that we lease, than they cannot take us out. Our small house is than included.

 If there are updates I shall post them, as long as it is possible….. .

Someone ask, why you don’t receive a free lawyer?

 I wrote them back,

Yes, it should be normal to ask a lawyer for free. But we came also to the point that we don't like to have a lawyer. Because we had many lawyers in the past and they cannot, they say that they do, but they cannot defend us. No lawyer took the contract from '86 serious. In where it is written how many meters ground the parents bought. They bought separated the house with a separated contract! The parents signed also a map and on the map is written that most of the meters of ground is in the house! Ground floor, first floor, rooftop, and balcony. The parents didn't understand that, cannot read the map. They went after warts to the ILA but they answered deal is a deal everything is okay. Later the ILA offered that they buy a peace of ground but turned back from it. The parents should buy two times a peace of ground!
In the process of the low court (after many, many years claiming that we are 'invaders') they 'offered' that we buy the ground for 60% of day value! Through our lawyers. And they said that we have to sign: after selling forbidden to sell. So, when we sign it, two times buying the same peace of ground (a big part from what is bought in '86) they throw us afterward out of the house because we cannot pay that amount!. While somebody offered it a lone for a few days we gave the money back after selling. But that is forbidden!
On the end of the process of the low court Ronit and I started to understand how the ILA did it. (not exactly, a 'Malach' 'appeared' one time in the office of our last lawyer. Only Ronit saw him. The 'Malach' said, talk only about the contract from '86 and nothing else and he was laughing!)
Ronit did that and the lawyer came very angry, and rejected to do that. We decided, okay we bring it (in a letter) by our self to court without you. It was the order from the judge that the ILA and we come with a letter with our 'wishes'.  So he should decide.
The judge rejected all the material from Ronit and did the 'Pesak-Din'.

Its like you go to the 'shuk' (market) to buy 2 kilo banana.  You pay for 2 kilo banana after wards at home you discover that you received only 1 kilo. You go back and say that to the seller what he did. His answer is a deal is a deal you have no right on the 2 kilo!

We discover that the ILA did that with many contracts. And they 'convince' many lawyers to stay away from their contracts. In fact it is a very grave state-crime. For so far we think we are the only one and the first one who ask a judge to look in the contract, like ours from '86. Without a lawyer, so they cannot use a lawyer to 'play' with us. What they did all the time.
The family has it very difficult with it because they are treated as heavy criminals like Ol...... . Now the state lawyer has to defend the ILA.

That Mister Ol.... . When he was the head of Jerusalem wrote a letter to the parents after the house was broken off. He wrote in the letter, 'Righteous happened it makes no different that you are a holocaust survivor. They say many thinks like this. You are not better!'
That's why I ask to pray for the family. The Germans took her (the mother of Ronit) out her house in Poland. And now the Israeli police with soldiers. While it was her house as a gift to us.... .

Update 12-12-2010

We just received the verdict and we lost. The judge gave us 2½ year to leave. The family is very emotional. So far as we now understand the verdict. The judge made no reference to the contract or that there is a difference between the contract and the map that gave a definition for what we purchased. In the contract is written that the family purchased an amount of square meters ground.

And the map tells us with the square meters is included: ground and roof top house, different floors and balconies of the house. From the house that is bought separately and paid for it separately.

To the low court we went with lawyers. And they don’t judge that the contract is right or wrong. Now in the middle court, without a lawyer, they do the same.

So we understand until now the state made it a law to steal ground and a house where the father so hard, years for worked. The purpose: to sell it for a big amount of money.  It is very painful. Our small house is within the boundaries of the ground that the family purchased. Also the house (extension), that they broke off. On this moment we don’t know if it has function to go to high court or not.
